Terms of Service

These terms are the agreement between you and FinAiQ for using FinAiQ. By creating an account or using FinAiQ, you accept them for yourself and for the organisation you represent.

1. Who we are and what these terms cover

FinAiQ is provided by the FinAiQ team (“FinAiQ”, “we”, “us”). “You” means the organisation that holds the account, and “users” are the people it allows to use it.

These terms cover the FinAiQ website, web app, mobile app, email and WhatsApp import, and the APIs and integrations we provide (together, the “service”). Our Privacy Policy and Cookie Policy form part of these terms.

2. Your account

You must be at least 18 and authorised to accept these terms for your organisation. Keep your account details accurate and your sign-in credentials secure, use two-step sign-in, and tell us straight away at support@finaiq.ai if you think someone has used your account without permission.

You are responsible for the users you invite, for what they do in FinAiQ, and for giving each of them access only to the folders they need.

3. Your data

You own the documents and data you or your users put into FinAiQ, including the data we extract from them (“your data”).

You give us permission to host, copy, process, transmit and display your data only as needed to provide, secure, support and improve the service, and as described in our Privacy Policy. When we process your data we act on your behalf and on your instructions.

You confirm you have the right to upload your data — including personal information about your suppliers, customers, staff or clients — and to have us process it, and that you have given any notices and obtained any consents the law requires.

4. How automated extraction works

FinAiQ uses automated systems, including AI services, to read documents and fill in data. Rule checks, cross-checks and review queues reduce errors, but no automated system is free of them.

You are responsible for reviewing data before you rely on it — before exporting it, paying a supplier, claiming a tax credit, or lodging a GST or other tax return. FinAiQ is software, not tax, legal or accounting advice.

5. Integrations with other services

When you connect accounting software (such as Xero, QuickBooks Online, Zoho Books or Tally Prime) or other services, you authorise us to access them on your behalf to read and write the data the connection needs. Your use of those services is governed by their own terms.

We are not responsible for third-party services, their availability, or changes they make that affect an integration. You can disconnect an integration at any time.

6. Acceptable use

You must not, and must not let anyone else:

  • use FinAiQ for anything unlawful, fraudulent or harmful, or upload data you aren't allowed to share;
  • upload malware, or try to break, probe or bypass the service's security or access controls;
  • access, or try to access, data belonging to others;
  • copy, reverse engineer, scrape or resell the service, or overload it with automated requests, except through the APIs we provide and within their limits;
  • use FinAiQ to build a competing product.

7. Plans, credits and payment

Fees, usage allowances (such as pages or credits) and billing periods are shown in FinAiQ when you choose a plan or buy credits. Prices exclude taxes such as GST unless stated, and those taxes are added where they apply. Payments are processed by our payment provider, Razorpay.

Paid plans renew automatically until cancelled. We may change prices for the next billing period with at least 30 days' notice. Fees are non-refundable except where the law requires otherwise. If a payment fails we may suspend paid features until it is made.

8. Changes to the service

We improve FinAiQ continually and may add, change or remove features. We won't materially reduce the core features of a paid plan during a billing period you have paid for. Planned maintenance is scheduled to keep disruption low.

9. Suspension and termination

You can cancel at any time in FinAiQ or by emailing support@finaiq.ai; cancellation takes effect at the end of the current billing period.

We may suspend or end your access if you seriously or repeatedly breach these terms, don't pay, or if continuing would create a legal or security risk. Where practical we will tell you first and give you a chance to fix the problem.

10. Exporting and deleting your data

You can export your data at any time while your account is open. After your account closes, we keep your data for 30 days so you can export it, then delete it from our live systems. Copies in backups are removed as those backups expire.

Documents you delete stay in the trash for 90 days, where you can restore them, and are then permanently deleted. We may keep records the law requires us to keep, such as billing records.

11. Our property and your feedback

We own FinAiQ and all intellectual property in it. While your account is active we give you a non-exclusive, non-transferable right to use the service under these terms.

If you send us suggestions, we may use them without obligation to you. We may use de-identified and aggregated information — including the corrections users make to extracted data — to measure and improve FinAiQ, including its extraction models. This never identifies you, your users or your clients.

12. Confidentiality

Each of us will keep the other's confidential information confidential and use it only for the purposes of this agreement, except where disclosure is required by law.

13. Warranties and consumer law

To the extent the law allows, FinAiQ is provided “as is” and “as available”, and we make no warranties beyond those in these terms.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where our liability for a failure to meet such a guarantee can be limited, it is limited, at our option, to supplying the service again or paying for it to be supplied again.

14. Limitation of liability

To the extent the law allows, neither of us is liable for indirect or consequential loss, or for lost profits, revenue, goodwill or data.

To the extent the law allows, our total liability arising out of or in connection with these terms is limited to the fees you paid us in the 12 months before the event that gave rise to the claim.

These limits don't apply to liability for fraud or wilful misconduct, or to liability that cannot be limited by law.

15. Indemnity

You will compensate us for losses arising from claims by third parties about your data or about your use of FinAiQ in breach of these terms or the law.

16. Changes to these terms

We may update these terms. If a change is material, we will tell you by email or in FinAiQ at least 30 days before it takes effect. If you keep using FinAiQ after that, the updated terms apply; if you don't agree, you can cancel before they take effect.

17. Governing law and disputes

These terms are governed by the laws of India, and the courts of Maharashtra, India have exclusive jurisdiction, subject to any rights you have under laws that cannot be excluded. Before starting proceedings, please contact us at support@finaiq.ai so we can try to resolve the issue informally.

18. General

These terms are the entire agreement between us about FinAiQ. If any part is unenforceable, the rest still applies. Not enforcing a right is not a waiver of it. Neither of us is responsible for delays caused by events beyond our reasonable control. We may transfer this agreement to a company that takes over the service, and will tell you if we do. Notices to you are sent to the email address on your account.
